Types of Robbery Charges

In Illinois there are three main types of robbery. Regardless of which type you or a loved one is charged with the consequences of conviction can have far reaching effects. These consequences include difficulty in obtaining employment, housing, loss of voting rights, and loss of gun ownership rights. 


Robbery

 

In order to be convicted of robbery in Illinois, the State must prove beyond a reasonable that the accused knowingly took property from someone else while using or attempting to use force. The statute on robbery can be found in the list of Illinois Compiled Statutes. Robbery in Illinois may be a Class 1 or Class 2 felony depending on the surrounding circumstances of the crime. For example, if the victim of the robbery was 60 years or older the offense should be charged as a Class 1 felony. A Class 1 is punishable by 4 to 15 years in prison, while a Class 2 felony is punishable by 3 to 7 years in prison, but probation is possible.


Aggravated Robbery


A robbery is aggravated if the accused indicated that he or she was armed with a gun or other dangerous weapon, or uses a controlled substance to subdue the victim during the commission of the offense. The statute for this offense can be found at the Illinois General Assembly. Aggravated robbery is a Class 1 felony in Illinois and not probation eligible. Upon conviction for an aggravated robbery a prison sentence of at least 4 to 15 years will be imposed.


Armed Robbery


To be convicted of armed robbery the State must prove that the accused either committed a robbery while carrying a dangerous weapon, or committed a robbery while armed with a gun, regardless of whether he or she discharged the gun. Armed robbery is a Class X felony, is not eligible for probation, and requires a prison sentence of at least 6 to 30 years. The Illinois statute for armed robbery can be found in the list of Illinois Compiled Statutes

Potential Defenses For Robbery Charges
